1. Contest and organiser

The online giveaway „"Vegan Protein Bar"” (here after "the giveaway") is offered by foodspring GmbH, Lobeckstr. 30-35, 10969 Berlin, Germany ("foodspring"). Participation in the contest is subject exclusively to the following conditions of participation.

2.1 Participation is open to anyone aged 18 years or older and living in the U.K. Participation is not open to employees of foodspring and affiliated companies and their family members.

2.2 Participation in the giveaway is only possible in the period 05-11 until 08-11 23:59. Participation in the win promotion is free of charge. Participation is possible until 08 November 2020 23:59 local time.

2.3 In order to take part in the winning action, all of the following conditions must be met:

1. Follow the account of foodspring U.K. on Instagram: @foodspring_uk.

2. Like the Vegan Protein Bar giveaway post.

3. Tag a friend in the comments.

Users who don't have a public Instagram account or none at all can't participate in this giveaway. Tagging our account will be used to get a notification in the Instagram inbox. Due to the large number of participants these notifications cannot all be read or opened by foodspring as this is a manual process. The winner will be randomly selected by selecting one of the notifications. This is then checked to see if all the conditions for participation have been met.

2.4. Only those who meet the conditions described in section 2.3 will take part in the giveaway. Foodspring cannot be held liable for late and/or incomplete entries. The tagging of a company or celebrity that is in no way related to the entrant will be disqualified from the competition.

3. Implementation and delivery of prizes

3.1 Only the prizes specified below will be raffled off:

3.2 The winner will be drawn by lot within 1 day after the end of the promotional period.

3.3 The winner will be notified that he or she has won a prize via the Instagram of @foodspring_uk. The raffle will take place after 08 November 2020. Within 1 day of receipt of the notification, the winner must confirm his/her name and email address associated with his/her foodspring account via the contact details provided in the notification; failure to do so will result in the prize being awarded to another foodspring entrant. In this respect, the entrant shall ensure that he/she is informed via his/her instagram account that he/she has won a prize by foodspring. The prize announced during the prize draw via our communication channels will be converted into local currency using the exchange rates on the closing day.

3.4 The claim to the prize may not be assigned or transferred. The prize may not be paid, supplemented or altered. If the prize cannot be made available to the winner for any reason, foodspring reserves the right to provide a replacement prize of equivalent value.

3.5 The contest is in no way sponsored, endorsed or administered by, or associated with, Instagram.

3.6 The prize can be regarded as a taxable benefit for the winner. The winner is fully and directly responsible for the calculation and payment of any taxes on the prize.

4. Exclusion from participation

4.1 In the event of a breach of these terms and conditions of participation, foodspring reserves the right to exclude participants from the competition.

4.2 In addition, foodspring reserves the right to exclude participants who use illicit devices or otherwise attempt to obtain advantages through manipulation (in particular by means of group participations or multiple participations, unless these are expressly permitted by foodspring). This applies, for example, if automatic scripts, hacker tools, Trojan horses or viruses are used or if a participant obtains advantages by other unauthorised means. The submission of incorrect personal data or the use of 'fake profiles' can also lead to exclusion. In such cases, prizes may be withdrawn and/or reclaimed, even after the event has taken place.

5. Premature termination or discontinuation of the contest.

Foodspring is entitled to prematurely stop, interrupt or change the competition in the event of unforeseen circumstances beyond the organiser's control which make the original performance more difficult or which mean that the original performance can no longer be required of foodspring. These circumstances include in particular, but are not limited to, unauthorised intervention by third parties, technical problems relating to hardware or software beyond the organiser's control, and infringements of the law directly linked to the performance of the contest, in particular manipulation of the course of the contest.

6. Transfer of rights

The participant transfers to foodspring all copyrighted rights of use and related rights that have arisen or will arise or have arisen or are to be acquired by him/her in photographs and/or photographic works permitted in the context of his/her participation in the competition for non-exclusive, repeated use, at will, for the purposes of the company's business in the locality, without limitation as to content, time and place.

8. Final provisions

8.1 An appeal to the courts is out of the question.

8.2 The law of the Federal Republic of Germany shall apply to the exclusion of private international law and the UN Convention on Contracts for the International Sale of Goods (Vienna Sales Convention or CISG) incorporated into German law.

We process contact data such as first name, last name, address, email address and instagram username of the winner in this contest.

In order to accept the prize, winners must give their permission to tag their Instagram Profile and publish Instagram Profile photo on our Instagram Stories. This Story will be automatically deleted after 24 hours.

3. Where does this data come from?

The data comes directly from you, as it is collected in the context of your participation in the game of chance.

4. For what purposes will my data be processed? On what legal basis does the company base this?

a. Article 6 par. 1 lit. b) AVGWe process personal data which are necessary for the performance of the contract between you and us relating to the contract of chance. This also applies to the processing necessary for the performance of the measures prior to the contract. The processing is carried out for the performance of contractually guaranteed services, e.g. the settlement of any claim for the price offered as part of the game of chance. The legal basis for this is Article 6 par. 1 lit. b) AVG. As part of the fulfilment and performance of the contract, we will process the data provided by you at the time of the conclusion of the contract or in the course of the contractual relationship. This includes in particular your master data (name, surname, date of birth, address, e-mail address, Instagram account).

b. Article 6 par. 1 lit. a) AVG If you have given us permission to process your data, we will process the data for the purpose stated in the statement of consent. You may revoke any consent granted at any time.

c. Article 6 paragraph 1 lit. f) AVGT also processes your data in order to protect the legitimate interests of us or third parties. This applies in particular to internal communications between affiliated companies and other administrative purposes.

As a matter of principle, you have the following rights:

In so far as we invoke our legitimate interest (Article 6(1)(f) AVG) as a legal basis, you have a right of objection under Article 21 AVG.

In accordance with Article 21 of the AVG, you have the right to object to the processing of personal data at any time. Even after exercising your right to object, we will not process your personal data for other purposes, unless we can prove that there are compelling reasons to protect the processing which outweigh your interests, rights and freedoms, or if the processing serves to recognise, exercise or defend legal claims (see Art Par. 1, par. 6 DSGVO, the so-called "limited right of objection"). In this case, you are only entitled to object if there are reasons arising from your specific situation.

7. Am I entitled to appeal?

Yes, you have the option of complaining directly to us or to a responsible supervisory authority for data protection.

8.How long will my data be stored?

We process and store your personal data for the duration of the existing contract. If the data is no longer required to comply with contractual or legal obligations, we delete the data regularly, but we must comply with legal storage obligations (in particular § 257 HGB and § 147 AO). These can last up to 10 years.

If data must be retained to ensure the enforcement of legal claims, the limitation period can be up to 30 years, with a normal limitation period of three years. If your data is used for advertising purposes, we will only process the data until you object to its use or you have withdrawn your consent or the use of this data is no longer legally permitted.

9. Do I have to leave my details to you?

In the context of our contractual relationship, you must provide the personal data necessary for the fulfilment and performance of the contract or for its processing to which we are legally obliged. If you do not make them available it would mean that we are regularly unable to conclude the contract with you.
